Refugee Law in Greece: International Protection and Asylum

Refugee law is an important area of Greek and European law, concerning the protection of persons who cannot safely return to their country of origin. In Greece, the main legislative framework is Law 4939/2022, which regulates, among other matters, the international protection procedure, the rights of asylum seekers, and the conditions for granting refugee status or subsidiary protection.

International Protection and the Asylum Procedure

International protection may be granted to persons who meet the legal requirements for recognition as refugees or beneficiaries of subsidiary protection.

The procedure includes the submission and registration of the application, a personal interview, and the issuance of a decision by the competent authorities. During the examination, the applicant’s personal statements, supporting evidence, and the conditions prevailing in the country of origin are assessed.

In the event of a negative decision, Law 4939/2022 provides, subject to the applicable legal requirements, for the possibility of lodging an appeal before the competent Appeals Committee. Compliance with the applicable deadlines is particularly important.
